Privacy Policy

Morton Learning respects your privacy. This policy explains how we collect, hold, use and disclose personal information when you visit our website, enquire about our services, enrol in or complete our real estate continuing professional development (CPD) courses, or otherwise deal with us.

We are committed to handling personal information consistently with the Australian Privacy Principles in the Privacy Act 1988 (Cth). We comply with the Privacy Act to the extent it applies to our business. Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable.

Information we collect

Depending on your dealings with us, we may collect and hold your name, email address, phone number, postal or billing address, employer or agency details, professional role, and real estate licence or registration details where needed to verify or report CPD completion.

We may also collect account and enrolment details; course selections; attendance, learning progress, assessment responses and results; completion dates, CPD points and certificates; invoices, payment status, transaction references and refund records; and correspondence, feedback, support requests and complaints.

When you use our website or learning platform, technical information may be collected, including your IP address, browser and device details, access times, pages visited, login activity and cookie identifiers. Some of this information may identify you or be linked to your account.

We do not normally need sensitive information. If you request accessibility support or an adjustment, we may need limited health or disability information. We collect sensitive information only with your consent and where reasonably necessary, unless collection is otherwise permitted or required by law. Please do not send unnecessary medical information or identifiable information about clients or tenants in course activities.

How and why we collect information

We generally collect information directly from you through website forms, account registration, enrolment and checkout, course activities, subscriptions, email, telephone and in-person interactions. We may receive information from an employer arranging training, a person you authorise, a payment provider or a relevant regulator where lawful and reasonably necessary. Where required, we will notify you about collection from another source.

You may browse our website or make a general enquiry anonymously or using a pseudonym where practicable. We need accurate identifying information to administer enrolments, issue certificates and meet applicable CPD reporting requirements. If you do not provide necessary information, we may be unable to provide these services.

We collect, hold and use personal information to respond to enquiries; establish and manage learning accounts; process enrolments, payments and refunds; deliver courses and learner support; assess participation and completion; issue and verify certificates; maintain CPD records; and meet applicable regulatory reporting and audit requirements.

We also use information to manage complaints, protect our systems, detect misuse, maintain business and accounting records, and improve our courses and website. Where practicable, we use de-identified information for service improvement. We use information for another purpose only with your consent or where otherwise permitted or required by law.

Sharing information

We may disclose relevant personal information to staff, trainers and contractors who need it to deliver or administer our services; providers of website hosting, learning platforms, IT support, email, communications and payment services; and professional advisers such as accountants and lawyers.

For CPD administration, reporting, verification or audits, we may disclose relevant participant and completion information to Consumer Protection within the Western Australian Department of Local Government, Industry Regulation and Safety, or its successor regulator, where required or authorised by law or applicable provider approval arrangements.

Where your employer or agency arranges your training, we may share enrolment and completion information where you have authorised this, it is reasonably expected and permitted by law, or disclosure is otherwise legally permitted. We do not routinely provide employers with your assessment answers, sensitive information or private correspondence. We may also disclose information to a person you authorise or to authorities where required or permitted by law.

We limit disclosures to information reasonably necessary for the purpose and take reasonable steps to require service providers to protect it. We do not sell or rent learner information for third-party marketing.

Overseas handling of information

Where we disclose personal information overseas, we take reasonable steps to protect it in accordance with applicable Australian privacy requirements. Using our website does not, by itself, constitute consent to waive the protections of Australian Privacy Principle 8.

Marketing communications

We may send information about courses and CPD updates where you have consented or where otherwise permitted by applicable privacy and spam laws. You may unsubscribe using the link in our marketing emails or by contacting us. We action unsubscribe requests within five working days. Opting out of marketing does not stop necessary enrolment, payment, support or course communications. We do not use sensitive information for marketing without your consent.

Cookies and website services

Our website may use cookies and similar technologies to support login sessions, shopping carts, security and website functionality. Where analytics or other third-party website services are used, they may collect browsing and device information. You can manage cookies through your browser settings; disabling some cookies may affect website functionality.

Storage security and retention

We hold information in electronic systems and, where needed, paper records. We take reasonable technical and organisational steps to protect it from misuse, interference, loss and unauthorised access, modification or disclosure. These steps include appropriate access restrictions, staff confidentiality requirements and safeguards suited to the systems and information involved. No storage or transmission method is completely secure.

We retain personal information for as long as reasonably needed to deliver services, verify CPD completion, manage enquiries and disputes, and meet applicable provider approval, legal, accounting and regulatory requirements. Retention periods vary by record type. When information is no longer needed and retention is not legally required, we take reasonable steps to securely destroy or de-identify it. Backup copies are managed through our backup retention processes.

If we become aware of a data breach, we will assess and respond to it, take reasonable steps to limit harm and, where required by the Notifiable Data Breaches scheme, notify affected individuals and the Office of the Australian Information Commissioner (OAIC).

Access and correction

You may ask to access personal information we hold about you or to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. Contact us using the details below. We may need to verify your identity before responding.

We respond within a reasonable period, generally within 30 days. There is no charge to make a request or to correct information. If a reasonable charge applies to providing access, we will explain it beforehand. If we refuse access or correction where permitted by law, we will give written reasons, unless it would be unreasonable to do so, and explain how to complain. If we do not make a requested correction, you may ask us to associate a statement of your position with the record. Where required, we will take reasonable steps to notify other recipients of a correction if you ask us to do so.

We will acknowledge your complaint, investigate it and aim to provide a written response within 30 days. If more time is needed, we will explain the reason and expected response date.
